PRIVACY AND DATA PROTECTION POLICY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with current legislation, LITW (hereinafter, also the &#8220;Website&#8221;) undertakes to adopt the technical and organisational measures necessary, in line with the level of security appropriate to the risk associated with the data collected.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legislation incorporated into this privacy policy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This privacy policy has been adapted to comply with current Spanish and European legislation on the protection of personal data on the internet. Specifically, it complies with the following regulations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).<\/li>\n\n\n\n<li>Spanish Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPD-GDD).<\/li>\n\n\n\n<li>Royal Decree 1720\/2007, of 21 December, approving the Regulation implementing Organic Law 15\/1999, of 13 December, on the Protection of Personal Data (RDLOPD).<\/li>\n\n\n\n<li>Law 34\/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Identity of the data controller<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The controller responsible for the personal data collected by LITW is: Alfonso Pich Rumeu, with NIF (Tax ID): 47657077L (hereinafter, the &#8220;Data Controller&#8221;). Their contact details are as follows:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contact email: info@litwstudio.com<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Register of Personal Data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In compliance with the GDPR and the LOPD-GDD, we inform you that personal data collected by LITW through the forms made available on its pages will be incorporated into, and processed in, our file for the purpose of facilitating, expediting and fulfilling the commitments established between LITW and the User, maintaining the relationship established through the forms completed by the User, or dealing with a request or query made by the User. Likewise, in accordance with the GDPR and the LOPD-GDD, unless the exception set out in Article 30(5) of the GDPR applies, a record of processing activities is maintained, specifying, according to their purposes, the processing activities carried out and the other particulars required under the GDPR.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Principles applicable to the processing of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The processing of the User&#8217;s personal data shall be subject to the following principles, set out in Article 5 of the GDPR and Article 4 et seq. of Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Principle of lawfulness, fairness and transparency: the User&#8217;s consent will be required at all times, following completely transparent information about the purposes for which the personal data is collected.<\/li>\n\n\n\n<li>Principle of purpose limitation: personal data will be collected for specified, explicit and legitimate purposes.<\/li>\n\n\n\n<li>Principle of data minimisation: the personal data collected will be limited to what is strictly necessary in relation to the purposes for which it is processed.<\/li>\n\n\n\n<li>Principle of accuracy: personal data must be accurate and kept up to date.<\/li>\n\n\n\n<li>Principle of storage limitation: personal data will only be kept in a form which permits identification of the User for as long as necessary for the purposes of its processing.<\/li>\n\n\n\n<li>Principle of integrity and confidentiality: personal data will be processed in a manner that ensures its security and confidentiality.<\/li>\n\n\n\n<li>Principle of proactive responsibility: the Data Controller will be responsible for ensuring that the above principles are complied with.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Categories of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The categories of data processed by LITW are identification data only. Under no circumstances are special categories of personal data, within the meaning of Article 9 of the GDPR, processed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal basis for the processing of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The legal basis for the processing of personal data is consent. LITW undertakes to obtain the User&#8217;s express and verifiable consent for the processing of their personal data for one or more specific purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The User has the right to withdraw their consent at any time. It shall be as easy to withdraw consent as it is to give it. As a general rule, withdrawal of consent will not affect the User&#8217;s ability to use the Website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the User must or may provide their data through forms in order to make enquiries, request information, or for reasons relating to the content of the Website, they will be informed if completion of any of the fields is mandatory because such information is essential for the proper handling of the request in question.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Purposes for which personal data is processed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data is collected and managed by LITW for the purpose of facilitating, expediting and fulfilling the commitments established between the Website and the User, maintaining the relationship established through the forms completed by the User, or dealing with a request or enquiry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data may also be used for commercial purposes of personalisation, operational and statistical purposes, and activities related to LITW&#8217;s corporate purpose, as well as for the extraction and storage of data and marketing studies, in order to tailor the Content offered to the User and to improve the quality, functioning and navigation of the Website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time personal data is obtained, the User will be informed of the specific purpose or purposes for which the personal data will be processed; that is, the use or uses that will be made of the information collected.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Personal data retention periods<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data will only be retained for the minimum period necessary for the purposes of its processing and, in any event, only for the following period: 5 years, or until the User requests its deletion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time personal data is obtained, the User will be informed of the period during which the personal data will be retained or, where this is not possible, the criteria used to determine that period.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Recipients of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The User&#8217;s personal data will be shared with the following recipients or categories of recipients:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Google LLC (Mountain View 1600 Amphitheatre Parkway Mountain View, CA 94043) Estados Unidos&nbsp;<\/li>\n\n\n\n<li>Meta Platforms Inc. (1, Hacker Way Menlo Park, CA 94025) Estados Unidos&nbsp;<\/li>\n\n\n\n<li>Piensa Solutions (Pol\u00edgono Industrial La Portalada, Circunde n\u00ba 16, 26006 Logro\u00f1o, La Rioja) Espa\u00f1a<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Should the Data Controller intend to transfer personal data to a third country or international organisation, the User will be informed, at the time the personal data is obtained, of the third country or international organisation to which the data is intended to be transferred, as well as of the existence or absence of a European Commission adequacy decision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Personal data of minors<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with Article 8 of the GDPR and Article 7 of Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights, only persons aged 14 or over may lawfully give their consent to the processing of their personal data by LITW. Where the data subject is under 14, the consent of a parent or guardian is required for the processing to be considered lawful, and it will only be lawful to the extent that such consent has been given.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Secrecy and security of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">LITW undertakes to adopt the technical and organisational measures necessary, in line with the level of security appropriate to the risk associated with the data collected, so as to guarantee the security of personal data and prevent its accidental or unlawful destruction, loss or alteration, whether transmitted, stored or otherwise processed, and to prevent unauthorised disclosure of, or access to, such data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Website has an SSL (Secure Socket Layer) certificate, which ensures that personal data is transmitted securely and confidentially, with data transmission between the server and the User, and vice versa, being fully encrypted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, since LITW cannot guarantee that the internet is impregnable, nor the complete absence of hackers or others who may fraudulently gain access to personal data, the Data Controller undertakes to notify the User, without undue delay, of any personal data breach likely to result in a high risk to the rights and freedoms of natural persons. In accordance with Article 4 of the GDPR, a &#8220;personal data breach&#8221; means a breach of security leading to the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorised disclosure of, or access to, such data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data will be treated as confidential by the Data Controller, who undertakes to inform its employees, associates and any other person to whom it makes the information accessible, and to ensure, by way of a legal or contractual obligation, that such confidentiality is respected by them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rights arising from the processing of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The User has, and may therefore exercise against the Data Controller, the following rights recognised under the GDPR and Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Right of access: The User&#8217;s right to obtain confirmation as to whether or not LITW is processing their personal data and, if so, to obtain information about their specific personal data and the processing carried out or being carried out by LITW, as well as, among other things, information available on the origin of such data and the recipients of any communications made or envisaged in respect of it.<\/li>\n\n\n\n<li>Right of rectification: The User&#8217;s right to have inaccurate personal data corrected or, taking into account the purposes of the processing, to have incomplete personal data completed.<\/li>\n\n\n\n<li>Right to erasure (&#8220;the right to be forgotten&#8221;): The User&#8217;s right, provided current legislation does not establish otherwise, to obtain erasure of their personal data where it is no longer necessary for the purposes for which it was collected or processed; where the User has withdrawn their consent to the processing and there is no other legal basis for it; where the User objects to the processing and there is no other legitimate ground for continuing it; where the personal data has been processed unlawfully; where the personal data must be erased in order to comply with a legal obligation; or where the personal data was collected in connection with the direct offer of information society services to a child under 14. In addition to erasing the data, the Data Controller, taking into account available technology and the cost of implementation, shall take reasonable steps to inform any other controllers processing the personal data of the data subject&#8217;s request to erase any links to that personal data.<\/li>\n\n\n\n<li>Right to restriction of processing: The User&#8217;s right to restrict the processing of their personal data. The User has the right to obtain restriction of processing where they contest the accuracy of their personal data; where the processing is unlawful; where the Data Controller no longer needs the personal data but the User needs it for the establishment, exercise or defence of legal claims; and where the User has objected to the processing.<\/li>\n\n\n\n<li>Right to data portability: Where processing is carried out by automated means, the User has the right to receive their personal data from the Data Controller in a structured, commonly used and machine-readable format, and to transmit it to another controller. Where technically feasible, the Data Controller will transmit the data directly to that other controller.<\/li>\n\n\n\n<li>Right to object: The User&#8217;s right to prevent the processing of their personal data, or to have LITW cease such processing.<\/li>\n\n\n\n<li>Right not to be subject to a decision based solely on automated processing, including profiling: The User&#8217;s right not to be subject to a decision based solely on automated processing of their personal data, including profiling, which produces legal effects concerning them or similarly significantly affects them, unless current legislation provides otherwise.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The User may therefore exercise their rights by means of written communication addressed to the Data Controller, with the reference &#8220;GDPR-litwstudio.com&#8221;, specifying:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The User&#8217;s full name and a copy of their national identity document (DNI). Where representation is permitted, identification of the person representing the User must also be provided by the same means, together with documentary evidence of that representation. The owners of such websites will have their own data protection policies and will each be responsible for their own files and their own privacy practices.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Complaints to the supervisory authority<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Should the User consider that there is a problem or breach of current legislation in the way their personal data is being processed, they have the right to effective judicial protection and to lodge a complaint with a supervisory authority, in particular in the State where they have their habitual residence, place of work, or the place where the alleged breach occurred. In the case of Spain, the supervisory authority is the Spanish Data Protection Agency (Agencia Espa\u00f1ola de Protecci\u00f3n de Datos) (https:\/\/www.aepd.es\/).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">II. ACCEPTANCE OF, AND CHANGES TO, THIS PRIVACY POLICY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is necessary for the User to have read and agreed to the terms regarding the protection of personal data set out in this Privacy Policy, and to have accepted the processing of their personal data, in order for the Data Controller to be able to carry out such processing in the manner, within the periods, and for the purposes indicated.
